The smoking gun, for the tax credit scam resides in the Oklahoma Tax Commission.
Here lie the headwaters of the corrupt souls that feed the streams of tainted money that
flows down the river of greed carrying the Oklahoma political power structure to the Gulf
of Shame.
Here is where the names of the corrupt and greedy are kept frozen in a hidden glacier. Where
applying the right heat to start the glacier melting would turn the head stream into
a scum laden river bearing the names of those greedy rats. Where only the first rats to squeal
will be heard and pulled to the safety of high ground, to watch their fellow rats drown.
It is our opinion that the Oklahoma Tax Commission is where the fraud is actually
implemented. Where an act of breach of trust and misuse of discretionary authority
continually occurs.
The legislation had to get through the state legislator and governor, and they certainly
carry a large burden of guilt.
Even if someone external is calling the shots, the Tax Commission is the agency responsible
for reviewing the plans using capable and competent staff. Tax Commission authorities and
those reviewing the plan have a fiduciary responsibility to question that which does not
meet the spirit and intent of the governments responsibility to protect the public interest.
Hiding behind self invoked legalities does not relief the Tax Commission of its responsibility
to use good judgment.
De-crimalizing fraud.
Owl: Like the Tax Commission Agency Administrator Tony Mastin invoking
those fathom experts in his claim "abuses of the program, which many
experts contend are legal" in his double talk intended to give the public a false sense
of security allowing the fraud to continue unnoticed. The Oklahoma Tax Commissions continues issuing "Determination Letters" within two business days of
receiving the claim. See

Any application for tax credits of this size would normally be examined and reviewed by multiple
competent low and mid level financial or accounting experts, any one of which should be more
than capable of seeing the fraud. But, this level of personal wouldn't have the clout to pull
this off. If the scams were facilitated at a lower level, with all of the hullabaloo
surrounding this scam, management would have gone back to investigate.
More likely, to keep the evidence as close to the vest as possible, normal level of review is
circumvented. Whatever the review situation is this level of fraud could only be pulled of
under the full knowledge and cooperation of all three commissioners and the agency administrator.
It is a safe bet these four, if even all four, are the only people who ever see any
documentation. See it or not they are all a party to the fraud.
The contradiction of this whole thing is Tax Commission officials are invoking their
discretionary authority to approve applications containing obvious misrepresentation.
Yet the same officials are claiming they lack the discretionary authority to disapprove
an obvious misrepresentation.
Here are the names of the people who are fully responsible and know where all the
skeletons are hidden.
Chairman: Thomas Kemp
Vice-Chairman: Jerry Johnson
Secretary-Member: Constance Irby
Agency Administrator: Tony Mastin
These are the fingers that put the prints on the smoking gun. We have to wonder just how
proud their families, friends, fellow church members, clients, business relations
are of them now?
And, a whole lot of other people who are keeping their mouths shut for job security. Now we
do not fault all of these people. It would be unfair to ask anyone to risk their job, who
were simply suspicious, and not in a position where they would be expect to have proof.
In summary it seems the Oklahoma Tax Commission with a history of bribery and kickbacks
among employees never missed a beat by continuing its fraud and conspiracy legacy
with tax credit abuse. Even after a Grand Jury described the Tax Commission as
institutionally bathed in fraud, conspiracy and corruption. The only lesson
the Tax Commission seemed to learn was that by cheating people out of state it
brought in the FBI. The Tax Commission has since refocused its fraud and
corruption within the borders of Oklahoma.
